Charfoos & Christensen, P.C. Reports a Special Court Hearing Set For Monday, December 20, 1999 in Case Involving Mel Farr Motors' On-Time DeviceDETROIT, Dec. 17 -- A special hearing has been set for Monday, December 20, 1999 at 11 a.m. before Judge Kaye Tertzag of the Wayne County Circuit Court to hear arguments on two major issues in the case involving Mel Farr Motors' on time/automatic cut off device. Plaintiffs' attorneys, Lawrence S. Charfoos of Charfoos & Christensen, P.C., Detroit, Michigan and Ken Hylton, Jr., have asked the court to certify a class consisting of all persons having an on time/cut off device installed in their motor vehicle, and also to rule on whether or not a permanent injunction should be issued halting use of these devices. The on time/cut off device disables a vehicle if the customer fails to make weekly or bi-weekly payments. Plaintiffs have produced industry experts who say the devices are dangerous and a fire hazard when not properly installed. Charfoos believes the court's decision to hold a special hearing to address these matters is appropriate given the severity of the issue and the attention the case has generated. "This cut off device has become a major safety and public policy issue that is being monitored nationwide by the media," says Charfoos. "The court is providing the parties with a forum that best serves the needs of the particulars of this case." Both the Used Car News and Auto News have reported on the case in recent weeks. Previously "The Today Show" and other national TV programs reported on the on time device. For further information, please contact Attorney Lawrence S. Charfoos at 313-875-8080 or Attorney Ken Hylton, Jr. at 313-965-1800.
